General Terms & Conditions

SCOPE OF APPLICATION

The following General Terms and Conditions (GTC) govern the contractual relationship between Blackyard GmbH (hereinafter referred to as “we”) and customers (hereinafter referred to as “you”) who purchase goods and services via this web store in the version valid at the time of contract conclusion. 

OFFER

The offers on our website are non-binding. They are valid only as long as a product is available. Price and assortment adjustments remain reserved. The products are described according to samples or supplier information. Slight deviations in size, color, structure and processing are possible.

ORDER AND CONCLUSION OF CONTRACT

With the online order, an e-mail order or, in the case of a telephone order, with the verbal transmission of the order data, you make a legally binding offer to conclude a purchase contract and accept these terms and conditions and the prices shown. You will receive a confirmation of receipt of your order. This confirmation does not constitute an acceptance of the offer by us. The legally binding contract comes into effect only with the dispatch of the order confirmation by e-mail.

PRICES

The prices are in Swiss Francs (CHF) without shipping costs. Shipping costs will be charged separately. The prices do not include VAT, as we are not subject to VAT.

Payment is only possible with the means of payment accepted in the webshop. At the moment these are:

Your payment is expected within 5 working days after receipt of order. If you do not make a payment within 30 days after receiving your order, the order will be cancelled. You will be informed about the cancellation by e-mail.

DELIVERY AND DELAYS

We currently deliver in Switzerland and the Principality of Lichtenstein. Deliveries are made from our warehouse in Münchenbuchsee. Shipment is usually within 5 working days after receipt of payment, provided that the goods are in stock. If goods are not in stock you will be informed by e-mail. General exceptions are indicated on the website. The delivery will be sent by Swiss Post (B-Post). If you wish a different delivery method of the Swiss Post, please contact us before completing the order. For urgent orders, we also recommend that you contact us in advance.

We are not liable for delivery delays caused by manufacturing companies, producers, third parties or by force majeure. In case of delivery delays of more than one month, you have the right to withdraw from the contract without prior reminder. If the delivery is not accepted by you or collected and returned to us, we will charge you the total transport costs and the additional costs incurred.

SHIPPING COSTS

The shipping costs (packaging and transport) are:

  • Switzerland: CHF 10.-
  • Europe: CHF 15.-
  • International: CHF 18.-

RIGHT OF RETURN

Ordered goods can be returned to us within 7 working days from the date of dispatch at your expense and risk. Excluded from the return are personalized goods, customized or personally printed goods, as well as special offers and promotions. There is no right of return here. Furthermore, there is no right of return for items that have already been used or opened. The goods must be undamaged, complete and in their original packaging. In addition, the reason for return must also be stated. If these criteria are met, you will be refunded the purchase price less shipping costs according to section 7. If the return criteria are not met, we may refuse to accept the return.

WARRANTY

Please check the delivered goods immediately and report any defects to us by e-mail immediately, but no later than 5 days after receipt of the goods. The defective goods must be returned to us within 10 days after receipt. The shipping costs will be paid by us. For late reports or returns, the warranty claim expires.

FINAL PROVISIONS

The GTC and the contracts, which are concluded based on these GTC, are subject to Swiss law under exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Bern. We reserve the right to change the GTC at any time. The current version will be published on our website and is valid from the date of publication. In the event that individual provisions of these GTC are wholly or partially invalid, the validity of the remaining provisions shall not be affected.
